Intruder found in Linn County judge's garage

A man who decided to break into a garage and take a nap in a car was likely unaware he was in Linn County Circuit Court Judge David Delsman’s home.

Four Albany police officers responded to the 7 a.m. Friday call, after Delsman’s wife discovered Moses Deleon, 41, sitting in a car inside the garage. Responding officers believe Deleon was under the influence of narcotics.

Deleon was arrested and charged with first-degree burglary, a Class B felony, and unauthorized entry to a motor vehicle. Officers also discovered Deleon had an outstanding warrant in Washington state, where he is wanted for second-degree assault.

Deleon was booked into the Linn County Jail, but he could be arraigned in Marion County to prevent potential conflicts of interest, because the victim in the case is a Linn County judge.
